As per the report received from police station Pali District Umariya dated 17.05.2023, appellant No.1 Kalloo Kol has died on 25.08.2002. His death certificate is annexed with the report. There is no reason to disbelieve the aforesaid report. As none of near relative of appellant No.1 has filed any application for leave to continue the appeal. Therefore, this appeal, as it relates to appellant No.1 Kalloo Kol, is dismissed as abated.

Let the word "dead and abated" be mentioned against the name of appellant No.1 Kalloo Kol in the cause title of appeal.

I.A.No.6426/2023 and I.A.No.6427/2023 the applicants under section 320(2) and 320(5) of the Cr.P.C have been filed by the injured/ complainant Shankar Koal @ Sevadi Koal and appellant No.2 Mole Koal for compromise. It is submitted that parties have amicably settled their dispute.

Parties are directed appear before Registrar (J-II) of this Court for recording their statement on compromise on 13.06.2023.

Registrar (J-II) shall record the statement of injured/ complainant Shankar Koal @ Sevadi Koal and appellant No.2 Mole Koal and after verifying the genuineness and correctness of the compromise, shall furnish his verification report.

List for final hearing on 19.6.2023.
