Judgment

This appeal under Section under Section 374(4) is filed against the order dated 09.02.2007 passed by III Additional Sessions Judge, Hoshangabad (M.P.) in S.T. No.71/2006 whereby the appellant is convicted for the offence under Section 325/34 and 323/34 of IPC.
During the pendency of this case, possibility of settlement through mediation was explored and this Court vide order dated 21.08.2023 has referred the matter for mediation.
As per the report received from the learned Sessions, Narmadapuram dated 11.09.2023, the mediation is successful. Report of mediator (Shri Hitendra Kumar Mihsra), Special Judge (Atrocities) dated 09.09.2023 is annexed. As per the report, compromise agreement has taken place between the parties.
After due consideration of mediation report, the instant criminal appeal is allowed and appellants Pintu@ Virendra, Hariram @ Narendra and Surendra are acquitted from the charges of offence punishable under Section 325/34 and 323/34 of IPC.
The fine amount, if any, deposited by the appellants shall be returned to him.
The bail bonds are discharged.
The order of the learned trial Court regarding seized property stands confirmed.
A copy of this order alongwith the record be sent to the concerned trial court.
