Judgment

The present Writ of Habeas Corpus is moved by way of house motion and My Lord the Hon’ble the Chief Justice has allotted the same to this Bench.
Heard Sri B.P.Raju, learned counsel for the petitioner, and Sri Vishnu Teja, learned Special Government Pleader, attached to the office of learned Advocate General, appearing for the respondent-State through virtual mode.
Learned counsel for the petitioner contends that on 14.05.2025 at about 7:30 P.M., the husband of the petitioner by name Sri Kalidas Vijaya Krishna, was arrested by respondent Nos.3 and 4 without registering any crime and confined him in illegal custody at Patamata Police Station, Vijayawada, Krishna District. Till today, the respondent Nos.3 and 4 did not produce him before the concerned Court, as such, the present Writ Petition is filed.
On the other hand, Sri Vishnu Teja, learned Special Government Pleader attached to the office of the learned Advocate General, submits that the husband of petitioner was arrested today at 10:00 A.M. in Crime No.123 of 2025 of Patamata Police Station, registered for the offence punishable under Section 303(2) of the Bharathiya Nyaya Sanhitha, 2023. He further submits that respondent Nos.3 and 4 are producing the husband of the petitioner before the learned IV Additional Chief Metropolitan Magistrate, Vijayawada, Krishna District. He further submits that the husband of the petitioner was involved in 38 similar cases, out of them, he was convicted in 16 cases. He further submits that the husband of the petitioner is repeatedly involving himself in similar cases and today also, he was caught red-handedly, while he was taking away the vehicle involved in the above crime.
In view of rival contentions, as the respondent Nos.3 and 4 are arrested the husband of petitioner in Crime No.123 of 2025 of Patamata Police Station, Vijayawada, Krishna District and as they are going to produce him before the concerned Magistrate today, no further orders are required to be passed in the present Writ petition.
Accordingly, the Writ of Habeas Corpus is closed, leaving it open to the husband of the petitioner to avail appropriate remedies available to him under law.
Pending miscellaneous applications, if any, shall stand dismissed in consequence.
