Judgment

Heard the parties.
Petitioner has been made accused in connection with B.T.P.S. Case No. 3 of 2023 corresponding to G.R. No. 76 of 2023 for the offences registered under sections 341, 323, 406, 420, 504, 506 and 34 of the Indian Penal Code, pending in the court of Ms. R.S. Topno, learned Judicial Magistrate, 1st Class, Bermo at Tenughat.
It is alleged that the petitioner along with co-accused Usha Devi had cheated the complainant who is a permanent employee of Govindpur Mines and had got access to his bank documents and withdrew significant amount of money from his account over a period of five years. It is also alleged that the petitioner and co-accused took loan in the name of the Informant worth Rs. 41.00 lakh.
It was submitted that the Informant used to take grocery materials from the petitioner and against that, he used to make cash payment. It was further submitted that notice under section 41(A) of the Cr. P.C was issued and he has complied with the said notice and similarly situated co-accused Usha Devi has been granted anticipatory bail by a Coordinate Bench of this Court.
Considering the fact that co-accused has been granted anticipatory bail by a Coordinate Bench of this Court and the petitioner has complied with the notice issued under section 41(A) of the Cr. P.C, petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of Ms. R.S. Topno, learned Judicial Magistrate, 1st Class, Bermo at Tenughat in connection with B.T.P.S. Case No. 03 of 2023 corresponding to G.R. No. 76 of 2023.
