Judgment
Heard learned counsel appearing for the petitioner and learned Addl. Public Prosecutor appearing for the State.
The petitioner, who is accused for the offence under Sections 323,341,417,504 and 406 of the Indian Penal Code, prays for anticipatory bail expressing
apprehension of his arrest in connection with C.P. Case No. 2486 of 2016, pending in the court of learned Judicial Magistrate, 1st Class, Dhanbad.
Learned counsel for the petitioner has submitted that the complainant issued cheque to the petitioner for supply of goods and to that effect there is
endorsement on the back of the cheque. Learned counsel has further submitted that due to business rivalry the petitioner has been made accused.
Learned counsel for the State has opposed the prayer for bail.
Be that as it may, this Court is of the opinion that such type of transaction is prevalent in the business and accordingly, the petitioner, above named, is
directed to surrender before the court below within three weeks from today, and in the event of his arrest or surrender, he shall be released on
anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial
Magistrate, 1st Class, Dhanbad in connection with C.P. Case No. 2486 of 2016 pending in the court of learned Judicial Magistrate, 1st Class,
Dhanbad.
