Judgment
Ravindra Maithani, J
Applicant Kakey Babu is in judicial custody in FIR No.353 of 2021, under Sections 411, 34 IPC, Police Station Kashipur, District Udham Singh
Nagar. He has sought his release on bail.
Heard learned counsel for the parties through video conferencing and perused the record.
It is argued that nothing was recovered nothing was recovered from the applicant; recovery was made from the co-accused, it is he, who named
the present applicant and the applicant is not a previous convict.
State counsel admits that there is no previous conviction recorded in the name of the applicant.
5 Having considered all these facts, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.
The bail application is allowed.
Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the
satisfaction of the court concerned.
This bail order be forwarded to concerned court as well as the concerned jail through e-mail also.
