Mohd. Jamshed, Member (A):

The applicant joined the services of the respondents as LDC in the year 1984. Subsequently, he earned promotions and, thereafter, on 28.02.2021, the applicant retired from service on attaining the age of superannuation.

2.

By filing the present OA, the applicant is seeking relief in terms of directions to the respondents to release his retiral benefits like gratuity, pension commutation, monthly pension with arrears and arrears of MACP etc., along with interest.

3.

The applicant contends that in this behalf he has made representations to the respondents. However, the same are still pending.

4.

Today, I heard Mr. Harkesh Parashar, learned counsel for the applicant and Mr. Amit Sinha for Mr. R.V. Sinha, learned counsel for the respondents, through video conferencing.

5.

At the outset, Mr. Harkesh Parashar, learned counsel for the applicant submits that the applicant would be satisfied, if the respondents are directed to dispose of his representations dated 23.06.2021 and 13.07.2021 by passing a reasoned and speaking order in a time bound manner. To such request of the applicant, there is no objection from the learned counsel for the respondents.

6.

Accordingly, without going into the merits, the present OA is disposed of with a direction to the respondents to dispose of the representations of the applicant dated 23.06.2021 and 13.07.2021 by passing a reasoned and speaking order, as early as possible, and in any case not later than two months positively from the date of receipt of a copy of this order. This shall be done without any prejudice to the rights of the respondents. Pending MAs, if any, shall also stand disposed of. There shall be no order as to costs.
