Judgment
Dhrub Narayan Upadhyay, J.—Heard learned counsel for the parties. The petitioner is accused in a case registered under Sections 323, 341, 307 & 506/34 of the Indian Penal Code.
It appears from the fardbeyan that petitioner and her husband tried to oust the informant from the house and in course of that informant was assaulted by means of axe on her head by accused Basant Yadav while this petitioner was assisting said accused.
It is submitted that accused Basant Yadav, against whom allegation of assault is there, has been granted regular bail by the Court below. There is only allegation against this petitioner that she was assisting her husband.
Learned counsel appearing for the State opposed the prayer for bail. Since the assailant has been granted regular bail by the Court below, above named petitioner is directed to surrender before the Court below within a period of three weeks from today and on such surrender she is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court of Sri Shwyambhu, learned Judicial Magistrate, Palamau at Daltonganj in connection with Bishrampur P. S. Case No. 52 of 2012 corresponding to GR. Case No. 978 of 2012 subject to the conditions laid down u/s 438(2) Cr. PC.
