Judgment
M. Jaichandren, J.—This contempt petition has been filed praying that this Court may be pleased to punish the Respondent for willful disobedience of the order passed of this Court, dated 15.2.2010, in W.P. No. 2789 of 2010.
This Court, by its order, dated 15.2.2010, had 2 directed the Respondent to dispose of the representation of the Petitioner, dated 1.2.2010, on merits and in accordance with law, after giving an opportunity of hearing to the Petitioner, as well as to the other parties concerned ,within a period of twelve weeks from the date of receipt of a copy of the said order.
At this stage of the hearing of the contempt petition ,the learned Government Advocate appearing for the Respondent had submitted that in spite of a notice of hearing having been served on the Petitioner, asking him to appear for the enquiry to be held, on 18.4.2011, the Petitioner did not appear on the assigned date. He had further submitted that one of the land owners had moved the Supreme Court by way of a Special Leave Petition. In such circumstances ,No. order could be passed on the representation of the Petitioner, dated 1.2.2010, as directed by this Court, by its order, dated 15.2.2010.
In view of the submissions made by the learned Government Advocate appearing for the Respondent, No. orders are necessary to be passed in the present contempt petition, as prayed for by the Petitioner. Hence, the contempt petition stands closed. No. costs. Connected Sub 3 Application No. 135 of 2011 is closed.
