Judgment
Heard both sides.
The petitioner has come up with the Writ Petition to direct Respondents 2 and 3 to give adequate police protection to petitioner and petitioner's family members to peacefully enter, participate, and perform worship at the Arulmigu Sudalaimadan Temple situated at Krishnapuram, Kadayanallur, Tenkasi District during the 04.09.2026 temple festival, ensure that the 6th to 8th respondents receive the temple tax from the petitioner, and facilitate petitioner family in participating in the temple festival without any hindrance.
The learned Counsel for the petitioner submitted that the subject temple festival commenced on 02.09.2026 and going on. It will be completed on 04.09.2026. 04.09.2026 is the main festival in which the private respondents No.6 to 8 and other villagers refused to receive temple tax from the petitioner. In the previous year, there was no issue in paying the temple tax and all the villagers jointly conducted the festival of the said temple. However, due to some friction the petitioner was not allowed to pay the temple tax this year and eventhough the festival commenced yesterday i.e., 02.09.2026, the petitioner could not participate in it. Hence, this petition has been filed.
The learned Government Advocate submitted that on the receipt of the petitioner's representation dated 19.08.2026 police enquired the matter on 02.09.2026. The petitioner as well as the rival party i.e., respondents 6 to 8 attended the meeting with the third respondent police. Both of them have filed undertaking an affidavit that they have jointly commenced the festival already. Temple festival commenced on 02.09.2026 and continuing today i.e., 03.09.2026 and tomorrow i.e., 04.09.2026 also and there is no refusal of collection of the temple tax from the petitioner. Hence, this petition may be dismissed.
The learned Counsel for the Respondents 6 to 8 submitted that there is no friction in the village, wherein the temple festival commenced on 02.09.2026 in which the petitioner participated. If the petitioner is ready to pay the temple tax there is no dispute in collecting the money. Since the temple festival is to be completed on 04.09.2026, there is no issue in the village. Though the petitioner and the respondents 6 to 8 appeared before the third respondent police and filed an undertaking affidavit, the festival is going on smoothly. Therefore, at this stage giving permission by the police may create a law and order.
In such view of the matter, there is no dispute or friction in the village, as per the statement of the learned counsel.
With the above observation, this writ petition is disposed of.
