P.Madhavan, Judicial Member This Original Application has been filed by the applicant seeking the following reliefs:

" i. Direct the respondents to consider the applicant for appointment as Postman in Thiruvananthapuram South Postal Division.

ii.

Declare the non reporting/notification of all existing vacancies as on 1.12.2015, is illegal and arbitrary and direct the respondents to fill up the balance vacancies of postman as available in Thiruvanathapuram South Postal Division taking into account the 45 vacancies available as on 1.12.2015.

iii.

Direct the respondents to fill up the 45 vacancies of Postman as available in Thiruvananthapuram South Postal Division (as per Annexure A5) in accordance with the ruled in force and consider the applicant against one such vacancies.

iv.

Any other further relief or order as this Hon'ble Tribunal may deem fit and proper to meet the ends of justice.

v.

Award the cost of these proceedings.

vi.

Call for the records leading to the issue of Annexure A2 and set aside Annexure A2 and direct the respondents to reassess the vacany position for the examination notified as per Annexure A1.''

Counsel for the respondents had filed a statement on last sitting date stating that the applicant is no more. Counsel appearing for the applicant submits that the statement can be taken on record. Since no cause of action survives, the Original Application stands abated. No costs.
