It is further submitted that the petitioner had already deposited a sum of Rs.1,72,000/- before the learned trial Court. Thus, the petitioner has deposited a total sum of Rs.5,97,000/- out of the total cheque amount of Rs.8,60,000/-, which constitutes approximately 69.42% of the total cheque amount. Accordingly, learned counsel submits that the petitioner has substantially complied with the order passed by this Court.
In view of the above, the interim order already granted by this Court is extended until further orders.
Mr. G.Meganathan, learned counsel for the respondent, submits that the petitioner has complied with the direction issued by this Court and that a sum of Rs.1,72,000/- had already been deposited before the learned trial Court in C.C. He therefore seeks permission for the respondent to withdraw the total sum of Rs.5,97,000/-, comprising the earlier deposit of Rs.1,72,000/- and the subsequent deposit of Rs.4,25,000/-.
In view of the submissions made by the learned counsel for the parties, the respondent is at liberty to file an appropriate application before the learned trial Court seeking withdrawal of the total sum of Rs.5,97,000/-. Such an application shall be filed within a period of three weeks from today. If any such application is filed by the respondent, the Trial Court is directed to release the aforesaid amount of Rs.5,97,000/- in favour of the respondent, within a period of three weeks thereafter.
In the mean time, the respondent shall file counter within four weeks and thereafter, two weeks’ time is allowed to the learned counsel for the Revision Petitioner to file a rejoinder affidavit to the counter filed by the respondent.
