Judgment
This Writ Petition has been filed seeking to direct the respondents 1 to 5 to grant permission for conducting the festival and traditional Drama in Sri Malayalathukaruppar, Sri Chinnakaruppar, Sri Kottai Kaliyamman, Sri Porpanaikottai Muniyandi Swami, Sri Munnodi Muneeswarar and Sri Mahal Muthumariyamman on 03.08.2026 and 04.08.2026 and pass such further or other orders.
The learned Counsel appearing for the petitioner submitted that respondents 6 to 8 are private parties who have nothing to do with the aforesaid temple and that the temple belongs to the entire village people. Therefore, it is for the villagers to conduct the temple festival. Hence, the petitioner seeks indulgence of this Court.
Mr. D. Rajaboopathy, learned Government Advocate, submitted that the fifth respondent police had already referred the matter to the third respondent for convening a peace committee meeting.
Heard the learned Counsel on either side and carefully perused the materials available on record.
In view of the above, the third respondent is directed to issue notice to the petitioner as well as the rival factions under Section 64 of the BNSS and convene and conclude the Peace Committee meeting on or before 02.08.2026. The third respondent shall also facilitate the constitution of a Village Temple Committee for the purpose of conducting the temple festival. It is made clear that the Temple Administrative Committee shall not excommunicate or exclude the petitioner or his family members from participating in the temple festival.
With the above directions, this Writ Petition stands disposed of.
