Judgment
V. Srinivas, J
Both the parties i.e., appellant Nos.2 and 3 and respondent are present and they are identified by their respective counsel. Photostate copy of Aadhar Cards of both the parties also placed on record.
I.A.No.2 of 2023 is filed under Order 23 Rule 3 r/w.Section 151 of CPC to record compromise between the parties.
The respondent by name S.Gopala Rao admits that he received Rs.65,00,000/- (Rupees Sixty Five Lakh only) by way of Demand Drafts as per the Memorandum of Understanding and he also submits that he has no further claim against appellants.
The terms and conditions are read over to the parties and they admitted the same are true and correct and also submits that they have no objection to record the compromise as per terms and conditions mentioned in the memorandum of understanding.
Pursuant to the above, I.A.No.2 of 2023 is ordered by recording compromise between the parties as per the memorandum of understanding. The terms of the compromise shall be part and parcel of the decree and judgment in A.S.No.341 of 2006.
Since the respondent received entire agreed amount under the memorandum of understanding, this appeal suit is decreed in-terms of compromise arrived at I.A.No.2 of 2023.
There shall be no order as to costs.
Interim orders granted earlier if any, stand vacated.
Miscellaneous applications pending if any, shall stand closed.
