Hon’ble Mrs. Manjula Das, Chairman:

The applicant by filing this OA under Section 19 of the Administrative Tribunals Act, 1985 has prayed for setting aside the suspension order dated 05.09.2018 (Annexure A-1) by declaring the same as illegal.

Respondents have filed the counter reply wherein it is stated that the suspension order dated 05.09.2018 has been revoked vide order dated 18.03.2019 (Annexure R/1) on the basis of the recommendation of a three-member committee specially constituted to conduct a Preliminary Enquiry into the conduct of the applicant which is admitted by learned counsel for the applicant, Mr. U. Srivastava.

Since the suspension order dated 05.09.2018 impugned in this OA has been revoked by the respondents themselves vide order dated 18.03.2019, during the pendency of this OA, the same has become infructuous.

In view of the above, the OA is dismissed as having become infructuous. There shall be no order as to costs.
