This application has been filed by the child in conflict with law (now he attained majority) for quashing the entire proceedings of Juvenile Case No.24 of 2025, pending before the Juvenile Justice Board, Pithoragarh under Sections 147, 323, 354, 504, 506 and Section 509 of the Indian Penal Code, 1860, Section 7 read with Section 8 of the Protection of Children from Sexual Offences Act, 2012.

Mr. Amit Kapri, learned counsel for the respondent no.2-informant/victim, the respondent no.3/minor victim through mother and respondent no.4-minor victim through father.

The applicant is present through video conferencing. He is identified by Mr. Piyush Sammal, Advocate.

The respondent no.2, the mother of the respondent no.3 and the father of the respondent no.4 are present through video conferencing. They are identified by Mr. Amit Kapri, Advocate.

The applicant, the child in conflict with law, informed that he is doing his Bachelor of Computer Applications.

The applicant, respondent no.2, the mother of the respondent no.3 and the father of the respondent no.4 submitted that they have settled all their differences and after resolving their differences, they are living happily and in harmony. The private respondents further submitted that they do not want to pursue the said case. They have requested to quash the said Juvenile Case No.24 of 2025, pending against the applicant.

Mr. Pradeep Lohani, Brief Holder has opposed the said request of the private respondents.

It is noticed that the applicant and the private respondents have settled their disputes and they are living happily and in harmony. Applicant is doing his Bachelor of Computer Applications. In these circumstances, in case, the proceedings are allowed to continue, it would amount to denial of complete justice to the parties. Therefore, it is a case, in which the inherent jurisdiction of this Court should be exercised to do real and substantial justice.

Consequently, the present Application, filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is allowed and the entire proceedings of Juvenile Case No.24 of 2025, pending before the Juvenile Justice Board, Pithoragarh, are hereby quashed qua the applicant.
