Judgment
Alok Kumar Verma, J
The applicant – accused has invoked the inherent jurisdiction of this Court under Section 482 of the Code of Criminal Procedure, 1973 to quash the chalani report dated 05.09.2017, cognizance/summoning order dated 09.05.2018 and the entire proceedings of Case No.37 of 2018, “State vs. Utasv Anand”, under Sections 354, 452, 504, 506 and 323 of IPC pending before the Juvenile Justice Board/ Ist Judicial Magistrate, Haridwar.
The applicant – accused Utasv Anand alias Mukul is present in-person and he is identified by Ms. Prabha Naithani, Advocate.
The respondent no.2, the informant/victim is present in-person and she is identified by Mr. Shariq Khurshid, Advocate.
Heard Ms. Prabha Naithani, learned counsel for the applicant, Mr. T. C. Agarwal, learned Deputy Advocate General for the State and Mr. Shariq Khurshid, learned counsel holding brief of Mr. Gaurav Singh, learned counsel for the respondent no.2/informant/victim.
The respondent no.2 and the applicant submitted that there were some private disputes between them and they have resolved their disputes. They further submitted that after resolving their disputes, they have filed a joint Compounding Application (CRMA No.3922 of 2019) along with affidavit of the father of the juvenile applicant and the affidavit of the respondent no.2. They further submitted that the compounding application along with the affidavits have been filed with their free will and without any pressure.
The learned counsel for the State has no objection.
Keeping in view of the totality of the facts and circumstances of the case, this Court is of the view that ends of justice would be met, if the chalani report dated 05.09.2017, cognizance/ summoning order dated 09.05.2018 and the entire proceedings of Case No.37 of 2018, “State vs. Utasv Anand”, under Sections 354, 452, 504, 506 and 323 of IPC, pending before the Juvenile Justice Board/ Ist Judicial Magistrate, Haridwar, are quashed.
Resultantly, the chalani report dated 05.09.2017, cognizance/summoning order dated 09.05.2018 and the entire proceedings of Case No.37 of 2018, “State vs. Utasv Anand”, under Sections 354, 452, 504, 506 and 323 of IPC, pending before the Juvenile Justice Board/ Ist Judicial Magistrate, Haridwar, are quashed.
The Criminal Miscellaneous Application No.1044 of 2018, filed under Section 482 of the Code of Criminal Procedure, is disposed of accordingly.
