For the reasons mentioned in the MA seeking condonation of delay in filing the RA, the same is allowed.

The only prayer in the OA is that the applicant should be extended the benefit of HSG-I. It was rejected by taking note of the fact that though his grievance was about the memo dated 18.08.2008, he did not pursue the remedy at the relevant point of time. The applicant contends that his claim is based on a continuing wrong.

Reliance is placed upon the judgment of the Hon’ble Supreme Court in Union of India vs. Tarsem Singh, (2008)8 SCC 648. This judgment has no bearing on the facts of this case. Further, if such a plea is accepted, the matters pertaining to promotion, seniority need to be examined even after the same has assumed finality.

We do not find any merit in the RA. It is accordingly rejected in circulation.
