This application has been filed on behalf of the RP for withdrawal of the petition under Section 9 of the IBC Code i.e. IB No.3353/2019, whereby CIRP was triggered vide order dated 31.12.2020. Form-FA has been placed on record. CoC consists of only one CoC member namely M/s. Jones Lang Lasalle Building Operations Pvt. Ltd (JLL) i.e. the original applicant in IB No.3353/2019. Ld. RP has confirmed the same. Further, there is no claim as stated by Ld. Counsel for the RP Mr. Aman Choudhary except the claim of JLL. Ld. Counsel for the RP also stated that the CIRP costs as well as fees have already been paid and nothing is due towards the Corporate Debtor.
In view of the above said facts, the present application i.e. IA No.3688/2022 stands allowed. The Corporate Debtor stands relived from the rigours of CIRP process. Accordingly, the CIRP proceedings shall stand closed. IB/3353/ND/2019 stands closed. RP stands discharged.
In view of the above said facts, all the pending applications i.e. IA/501/ND/2021, IA/4586/ND/2021 & IA/2016/ND/2022 stand infructuous.
Ld. RP is directed to hand over all the relevant documents and management of the Corporate Debtor to the Suspended Board of Directors.
