Jogendra Munda vs Central Coalfields Ltd. and Others

Learned Counsel appearing for the petitioner submits that the petitioner''s father namely, late Kamal Munda, while working as ''Ward Boy'' under the employment of Central Coalfields Limited, died in harness on 22.9.1993 but the petitioner, being minor, did not file any application for compassionate appointment until 3.6.1996. When the petitioner attained majority, he filed an application, but that application was dismissed on 30.9.1999 for the reason that the petitioner''s name did not find place in the service book of the deceased employee-late Kamal Munda. The petitioner came to know this only when such information was given to him on 3.10.2009 when an application to this respect was filed by him under Right to Information Act.

According to the case of the petitioner itself, he attained majority on 3.6.1996 and only then he filed an application for his appointment on compassionate ground which was rejected on 30.9.1999. However, according to the petitioner, he came to know about that decision only in the year 2009, when he filed an application for supplying information in this respect. Thus, it does appear that he waited almost for more than 14 years for the decision which simply indicates that the pettioner does have sufficient incomes to sustain himself. Under this situation as well as in the facts and circumstances that the petitioner did approach this Court after more than 10 years of the rejection of his claim, prayer made in this application is fit to be rejected.

Accordingly, this application is dismissed.
