Judgment
Heard Mr. S Lodh, learned counsel appearing for the petitioner as well as Mr. D Bhattacharjee, learned GA appearing for the respondents.
Issue notice calling upon the respondents to show cause as to why rule shall not be issued, as prayed for; and/or why such further and other order(s) shall not be passed as to this Court may deem fit and proper.
Notice is made returnable on 12.05.2020.
Since, Mr. Bhattacharjee, learned GA appears and waives notice for the respondents No. 1 to 4, no formal notice is called for, so far as these respondents are concerned.
However, the petitioner shall take steps for service of notice on the respondent No.5 by speed post with A/D by tomorrow (24.04.2020), after receipt of a copy of this order, authenticated by the Registrar (Judl.), High Court of Tripura.
The notice shall be served with that copy of the order only and steps for formal notice shall be taken on the opening day of the court.
While serving the notice by speed post, Mr. Lodh, learned counsel shall categorically state by a forwarding letter to the respondent No.5 that this matter will be taken up for final disposal on the returnable date, if permitted by the circumstances.
Till then, the respondents shall refrain from taking any final decision in respect of the settlement of M.G. Bazar F.L. Shop No.3, in terms of DNIT dated 15.01.2020 (Annexure-1 to the petition), if not settled already.
However, the respondents No.1 to 4 may allow the present vendor to carry on the business in the premises, so that loss of revenue can be avoided.
Copy of this order be provided to the learned counsel for the parties having been authenticated by the Registrar (Judl.).
List the matter accordingly.
