Judgment
The present petitions have been filed seeking modification of the order dated 12.11.2024 passed in A.B.A. No. 1855 of 2024 with A.B.A. No. 1856 of 2024 with A.B.A. No. 1857 of 2024 whereby the concerned opposite parties were granted anticipatory bail consequent upon the amicable settlement of the dispute in the mediation proceedings conducted at Jharkhand State Legal Services Authority (JHALSA), Ranchi in terms with settlement dated 25.10.2024.
The present petitions were earlier taken up on 14.08.2026 and on the said date, the following order was passed:-
“Heard learned counsel for the parties.
2.All the aforesaid three Cr. M. Ps. have been filed seeking modification of the order dated 12.11.2024 passed in ABA Nos.1856 of 2024, 1855 of 2024 and 1857 of 2024 respectively whereby the concerned Opp. Parties were granted anticipatory bail on the basis of amicable settlement of the dispute in the mediation proceeding conducted at JHALSA, Ranchi, particularly as per the terms and conditions of the settlement dated 25.10.2024.
3.Learned counsel for the petitioner submits that though the petitioner has fulfilled all the terms and conditions mentioned in the Settlement dated 25.10.2024, yet the private Opp. Parties in these cases are not registering the land in question, much less providing the physical possession of the same.
4.Mr. V. K. Tiwari and Mr. Vikash Kumar, learned counsel for the respective private Opp. Parties on instruction submit that since the petitioner wants that the sale-deed of the land in question, should be executed in the name of assignee of the petitioner and not in his favour, the said condition has not yet been fulfilled/ performed by the concerned Opp. Parties.
5.At this juncture, learned counsel for the parties agree that if the present matters are again referred for mediation at JHALSA, Ranchi to resolve the issue with respect to the condition no.6 of the settlement dated 25.10.2024, the said issue may possibly be sorted out amicably.
6.Considering the submissions of the learned counsel for the parties, let the matters be again referred to JHALSA, Ranchi so as to enable the petitioner and the concerned private Opp. parties to resolve the issue concerning condition No.6 of the settlement dated 25.10.2024 through mediation.
7.The Member Secretary, JHALSA, Ranchi is directed to appoint an experienced Mediator (If possible, the same Mediator who had mediated between the parties on the earlier occasion) so as to try and resolve the said dispute between them amicably.
8.The concerned parties shall appear before the Member Secretary, JHALSA, Nyay Sada, Doranda, Ranchi on 1st September, 2026 at 11:00 a.m.
9.On their appearance, the Member Secretary, JHALSA, Ranchi, shall assign the matter to the Mediator whereafter the mediation proceeding will be conducted between the parties.
10.The Mediator shall submits its report by 17.09.2026.
11.Put up these cases on 18.09.2026 under the heading for “Orders”.”
Pursuant to the aforesaid order, mediation report contained in letter no. 7334-A dated 03.09.2026 under the signature of the Mediator JHALSA, Ranchi has been placed on record.
Learned counsel for the petitioner as well as the private opposite parties while referring to paragraph-6 of the settlement agreement dated 01.09.2026 (annexed with the mediation report dated 03.09.2026) submit that the subsisting dispute between the parties has now been resolved.
Under the said circumstance, learned counsel for the petitioner submits that there is no need of any modification in the aforesaid order passed by this Court.
Considering the said submission, all the present petitions are accordingly disposed of.
Office is directed to furnish copies of the settlement agreement dated 01.09.2026 to Mr. Dhananjay Kumar Pathak, learned counsel for the petitioner, as well as Mr. Vishal Kumar Tiwari and Mr. Vikash Kumar, learned counsel appearing on behalf of the private opposite parties in respective Cr.M.Ps.
