Heard the learned counsels for the parties.

By way of the present OA filed under Section 19 of the Administrative Tribunals Act, 1985, the applicants seek the following reliefs:

“(i)

Not to effect recovery calculated w.e.f. 2016 And

(ii)

Fix pay properly in all the relevant grades.

(iii)

To refund the sum which has already recovered from the salaries

(iv)

Grant any other relief as deemed fit for ends of justice.”

From the aforesaid prayer of the applicants, it is evident that there is no specific relief which has been sought by the applicant. However, learned counsel for the applicants submits that one Mr. Shankar Singh Baghel, who is junior to the applicants, as apparent from the provisional seniority list of Technician-I/Technician (OPENLINE) in Level-5 dated 10.07.2025 (Annexure A-5), is getting higher pay than the applicant.

Learned counsel for the applicants fairly submits that the applicants have not preferred any representation to the respondents for stepping up of his pay and/or for redressal of his grievances.

In the light of the aforesaid, under instructions, learned counsel for the applicants seeks liberty to withdraw the present OA with liberty to the applicants to agitate their grievance before the competent authority amongst the respondents within three weeks of receipt of a certified copy of this order and with a direction to the respondents to consider such representation in a time bound manner.

In the light of the aforesaid, permission sought is granted. The OA stands dismissed as withdrawn with following directions:

i.

The applicants shall be at liberty to make a comprehensive representation before the competent authority amongst the respondents for redressal of their grievances within three weeks from today.

ii.

Thereafter, the competent authority amongst the respondents shall consider such representation(s) of the applicants by passing a reasoned and speaking order preferably within eight weeks from the date of receipt of such representation from the applicants.

The OA stands disposed of in the aforesaid terms.No costs.
