Jitendra Kumar vs The State of Bihar and Others

Grievance of the petitioner is that his 5 years old daughter is missing. The suspicion is against his wife and his father-in-law. There are disputes between the petitioner and his wife and at the instance of the wife, Complaint Case No. 1589/2007 has been filed against the petitioner u/s 498(A) I.P.C. The petitioner also lodged Complaint Case No. 1147(C) of 2008 against his father-in-law and others, which was later on registered as Khagaul P.S. Case No. 139/2008 under Sections 452, 363, 380/34 I.P.C. There are family disputes between the petitioner and his wife and they are quarrelling over custody of their minor daughter and making allegations against each other.

In the above circumstances, we direct the police to make investigation into both the cases, one which has been filed by the petitioner against his wife and his father-in-law and the other which has been filed against the petitioner by his wife, and take appropriate actions in the matter in accordance with law. With the above observations, the writ petition stands disposed of.
