Judgment
The issue involved in this original application is in respect of violation of environmental norms by 138 brick kilns impleaded as Respondent Nos. 5 to 142 in this OA and operating in Hisar District of Haryana.
On the direction of the Tribunal contained in the proceedings dated 03.02.2023, the reports were submitted and, thereafter, on 19.07.2023, the State PCB and Members of the joint Committee had sought short adjournment to file the comprehensive report in compliance of the earlier order.
A request letter for extension of time to complete the action taken report in compliance of the order of the Tribunal dated 03.02.2023 has been circulated by the Regional Office, Hisar Region, Haryana State Pollution Control Board (HSPCB).
Learned Counsel appearing for the HSPCB has submitted that the comprehensive report in terms of the earlier order will be positively filed within eight weeks by e-mail at [email protected] preferably in the form of searchable PDF/OCR Support PDF and not in the form of Image PDF.
IA No. 680/2023 has been filed by the applicant for withdrawal of the OA. The OA involves serious issue relating to operation of large number of brick kilns with the allegation of violation of environmental norms. The Tribunal has already issued directions considering the allegation made in the OA and the reports are awaited.
In these circumstances, we are of the view that the issue involved in the OA is required to be considered and appropriate orders need to be passed for protecting the environment. Thus, we permit the applicant to withdraw himself from the OA and take up the matter in suo motu exercise of power. IA No. 680/2023 is accordingly disposed off.
