Judgment

This writ petition has been filed for the following substantial prayer:-
"(i) That in view of the above mentioned facts that respondents may kindly be directed to regularize the services of the petitioner as Lecturer (Maths) w.e.f. the year 2007 instead of the year 2009 along with all consequential benefits, in the interest of justice and fair play."
The relief of regularization has been prayed by the petitioner on the strength of the judgment dated 1.9.2015 rendered in LPA No.146/2010 and connected matters. In reply filed to the writ petition, the respondents have stated as under:-
"3. That keeping in view the judgment passed by this Hon'ble Court in above mentioned writ petitions and LPAs and further approval of the Govt. dated 21.1.21, the regularization to the petitioner is allowed vide order dated 30.6.21 with all consequential benefits from the date when the services of his junior in contract services in the subject of Mathematics were regularized by considering the initial contract engagement in relevant subject. As per information received from the concerned Principal, Arrear Amounting to Rs.31530/- has also been paid to the petitioner."
During hearing of the case today, learned Assistant Advocate General has placed on record the copy of office order dated 30.06.2021 alongwith regularization order passed by the respondents on the basis of the judgment delivered in LPA No.146/2010, whereunder the name of the petitioner figures at serial No.65. As per this order, petitioner's services have been regularized w.e.f. 31.12.2008 at par with the junior contractual regularized.
In view of the aforesaid order, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file fresh petition for assailing the fresh regularization order passed by the respondents on 30.06.2021. Prayer being innocuous has not been opposed by learned Assistant Advocate General. Accordingly, the petition stands dismissed as withdrawn with leave and liberty as prayed for. Pending miscellaneous application(s), if any, shall also stand disposed of.
