Judgment
Let the hard copy of the counter affidavit filed on behalf of the respondent be kept on the record.
Heard Mr. Prabhat Ranjan Singh, learned counsel appearing on behalf of the petitioners, Mr. Anwar Karim, learned counsel appearing on behalf of the Zila Parishad and Mr. Vinay Kirti Singh, learned GA-2, along with Mr. Binay Kr. Pandey, learned counsel appearing on behalf of the State.
Learned counsel appearing on behalf of the petitioners submits that petitioners are ready to deposit the rent fixed by the rent controller will be paid within six weeks, which will be subject to the final result of the appeal filed by the Zila Parishad.
Considering the aforesaid submission made on behalf of the petitioners that for the entire period the rent is due, as claimed by the Zila Parishad, will be paid by the petitioners within a period of six weeks. The petitioners, after depositing the rent may file its acknowledgment before the Appellate Court, as well as, before the executive officer of the Zila Parishad.
The amount deposited by the petitioner will be subject to the final outcome of the Appeal.
Accordingly, the present writ petition stands disposed of.
