Heard Shri S.J. Ishtiaque, learned counsel for the applicant and Shri Vidyapati Tripathi, learned counsel for the respondents.
Learned counsel for the applicant referring to the relief clause has made a statement at the Bar that the respondents have permitted the applicant to appear in the examination provisionally and the applicant has already appeared in the said examination and as such, the instant original application has become infructuous.
Learned counsel appearing on behalf of the respondents conceded to the statement of the learned counsel for the applicant.
In view of the above position, OA No. 78/2023 is dismissed as having become infructuous. All the associated MAs shall also stand disposed off.
