Heard Mr. Satya Prakash Sinha, learned counsel appearing on behalf of the petitioners, Mr. Raghwendra Kumar, learned counsel appearing on behalf of the State of Bihar, Mr. Sanjay Kumar Pandey, learned counsel appearing on behalf of the State of Jharkhand and Mr. Vikramadit, learned counsel appearing on behalf of the Accountant General.

The petitioners are legal heirs of deceased employee namely Late Ram Sagar Sharma, who was compulsorily retired while he was posted as Driver in Dumka Division vide Memo No. 752, dated 02.06.1999.

Learned counsel appearing on behalf of the petitioners seeks to withdraw the present writ petition with liberty to file detail representation before the Administrator, Bihar State Road Transport Corporation, Patna, respondent no. 2.

The Administrator, Bihar State Road Transport Corporation, Patna, respondent no. 2 is directed to dispose of the representation of the petitioners after determining the entitlement of the petitioners to receive pensionary benefit on account of death of the deceased employee namely Late Ram Sagar Sharma, within a period of six weeks and make payment within the aforesaid period with all statutory interest amongst all the legal heirs of the deceased employee in accordance with law.

With the above observation and direction the writ petition stands disposed of.
