The applicant herein was appointed as a Dancer in Song and Drama Division under Ministry of Information and Broadcasting. The applicant has
since superannuated on 28.02.2019.
While in service, when 7th CPC pay fixation was granted w.e.f. 01.01.2016, certain pay fixation (Rs 1,15,500/-) was given to her and she was paid at
that level until November 2017. However, for the month of December 2017, the pay was reduced to Rs 85,800/- without even issuing a show cause
notice.
Applicant is also aggrieved that certain 7th CPC arrears have also not been paid. The applicant had made certain representations dated 18.01.2018
and 24.02.2019 and it is pleaded that these have not been replied to as yet.
Feeling aggrieved, the instant OA has been filed seeking certain benefits/directions relating to this pay fixation.
Issue notice. Sh. R.K.Jain, learned counsel, who appears on behalf of respondents on advance information, accepts notice.
At this stage, the learned counsel for applicant pleads that they would be satisfied if liberty is given to the applicant to make a comprehensive
representation and the respondents be directed to decide the same within a fixed time period.
The Tribunal has considered the request made by the learned counsel for applicant across the Bar. It is felt that no prejudice is likely to be caused
to the respondents, if such a request is agreed to.
In view of the foregoing, present OA is disposed of at the admission stage itself, without going into the merits of the case, with liberty to the
applicant to make a comprehensive representation in writing, within a period of three weeks from today. In case such a written representation is
received by the respondents in this time frame, they are directed to pass a reasoned and speaking order on the same, keeping in view the extant rules
and regulations into account, within a period of eight weeks thereafter, under advice to the applicant.
In case, as a result of this examination, certain payments are found to be due to the applicant, the respondents are also directed that such payments
shall also be released to the applicant within a period of four weeks thereafter. No costs.
