Judgment

Present writ petition has been filed under Article 226/227 of the Constitution of India for the issuance of a writ in the nature of mandamus directing the respondents to allow the petitioner to sit for the final exams for the MBA International Business (Final Year) and condone the shortage of attendance of lectures of the petitioner on the basis of the grounds mentioned therein.
Learned counsel for the petitioner has submitted that during the pendency of the present writ petition, the order dated 16.04.2024 has been passed by the Office of Dean (Academics) and in the said order, reference has been made to Clause 3.2 of Academic Regulations of the University of MBA course and thus, the petitioner seeks to withdraw the present writ petition with liberty to file a fresh petition after laying challenge to the said order and also laying challenge to the regulations.
In view of the above statement of learned counsel for the petitioner, the present writ petition is dismissed as withdrawn, with the aforesaid liberty.
It is made clear that in case any such petition is filed by the petitioner, the same would be considered independently, in accordance with law.
