Judgment
This is an application under Section 438 Cr.P.C. for grant of pre-arrest bail. The applicants apprehend arrest in connection with Khanapara
P.S. Case No. 52(12)2017 under Section 307/326 IPC. The pre-arrest bail application of the applicant under Section 438 Cr.P.C. was rejected
by the District Judge by an order of 10th January 2018.
The Court has perused the FIR dated 24.12.2017. The allegation is that there was an attempt on the life of the informant by attacking him with
the sword. It is alleged that the informant received serious injuries.
The Investigating Officer, who is present today has submitted the Case Diary. On the perusal of the Case Diary, one finds that the First
Informant has been examined and the medical report has also been taken on record. The medical report indicates a minor laceration on the left ear
and the informant was discharged after first aid.
In view of the aforesaid, the Court finds prima facie that the injury was not grievous in nature. The Court directs that the applicant shall not be
arrested during the investigation pursuant to Case Crime No. 52(12)2017 under Section 307/326 IPC. The applicant, will however, cooperate in
the investigation and will appear before the Investigating Officer as and when required. Application disposed of.
