Judgment
Heard both learned counsels for the applicant as well as for the respondents.
At the outset, Shri Praveen Kumar, learned counsel for the applicant, submitted that this is a case where the applicant has not been restored his commuted pension as per rules although a period of more than 15 years has been passed since the pension was commuted. He further stated that the applicant has made a representation to the respondents in this regard on 24.03.2021, (Annexure A/5), and submitted that he would be satisfied in case the respondents are directed to consider this representation and decide the same within a reasonable timeframe after giving an opportunity of a personal hearing to the applicant.
At this, Shri Ashutosh Pathak, learned counsel for the respondents, submitted that in case the representation in question is to be decided in the manner suggested, a period of at least one month may be for allowed for this purpose.
Looking to the limited nature of the plea made by the learned counsel for the applicant and without entering into the merits of the case, I deem it appropriate, in the circumstances, to dispose of this OA at the admission stage itself by directing the respondents to consider the representation made to them by the applicant on 24.03.2021, (Annexure A/5), and pass a reasoned and speaking order in accordance with law on the same after affording the applicant an opportunity of a personal hearing, within a period of one month from the date of receipt of a certified copy of this order.
Original Application is disposed of accordingly.
There will be no order on costs.
