This Criminal Petition, under Sections 437 and 439 of Cr.P.C., is filed by the petitioner/A.2 to grant regular bail in connection with Crime No.417 of 2024 of Patamata Police Station, Vijayawada, Krishna District registered for the offences punishable under Sections 370A(2) and 370(3) I.P.C. and Sections 3, 4, 5 and 7 of the Immoral Traffic (Prevention) Act.

Heard Sri J.V.N.Maneendra, the learned counsel for the petitioner and the learned Assistant Public Prosecutor for respondent/State.

Perused the record.

Having heard both sides and having perused the record, the following facts are seen:

The raid party along with panch witnesses raided a premises bearing D.No.54-20/6-10 at Kanaka Durga Gazetted Officers Colony, Gurunanak Colony, Vijayawada. The allegations are that A.1 took the said premises on lease and had been running a brothel house. When the raid was conducted, two customers and two sex workers were found and condom packets were recovered. Money paid by the customers was recovered from A.2/petitioner herein, who has been allegedly managing the premises on behalf of A.1.

This petitioner was arrested and remanded to judicial custody on 27.05.2024 and since then he has been in custody. More than six weeks elapsed and best part of the investigation is completed.

Considering the allegations levelled against the petitioner, any further detention does not seem necessary. Therefore, prayer is granted.

In the result, this Criminal Petition is allowed. The petitioner/A.2 shall be enlarged on bail on his executing a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of the like sum each to the satisfaction of the learned Metropolitan Sessions Judge-cum-II Additional District Judge at Vijayawada. The petitioner/A.2 shall mark his attendance before the Investigating Officer once in a fortnight i.e., on 1st and 15th of every month between 10.00 AM and 1.00 PM till filing of the charge sheet. The petitioner shall make himself available for interrogation by a police officer as and when required, and he shall not, directly or indirectly, make any inducement, threat or promise to any persons acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer. He shall not indulge in similar acts of crime.
