This is a second petition filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in a case FIR No.128 dated 04.07.2021, registered under Sections 323, 324, 452, 506, 427, 148 and 149 IPC (Section 326 IPC has been added later on), at Police Station Goindwal Sahib, District Tarn Taran.
A perusal of the record would show that after the dismissal of the anticipatory bail of the petitioner by the Additional Sessions Judge, Tarn Taran, vide order dated 26.07.2021, the petitioner had filed a petition bearing CRM-M-36188-2021, which was dismissed by this Court, vide order dated 03.09.2021 (Annexure P-3) on merits. The present anticipatory bail application has been filed after a period of more than two years and eight months from the date of the dismissal of the said anticipatory bail application and the same is completely misconceived.
Learned counsel for the petitioner, in view of the above, seeks to withdraw the present petition.
