Present petition has been filed under Section 528 of the BNSS, 2023 (Section 482 of the Cr. P.C.) for issuance of directions to respondents No.2 and 3 to take action against respondents No.4 to 14 by considering the representation dated 17.07.2026 (Annexure P-2) in view of the decision of the Constitution Bench of the Hon’ble Supreme Court in Lalita Kumari versus Govt. of U.P. and others, AIR 2014 (SC) 187.
Learned counsel for the petitioner submits that the petitioner would be satisfied, in case a direction is issued to respondent No.2 – Senior Superintendent of Police, Gurdaspur, District Gurdaspur to consider and take a conscious decision on the representation dated 17.07.2026 (Annexure P-2) made by the petitioner.
On the other hand, on the asking of the Court, Mr. Adhiraj Singh Thind, AAG Punjab causes appearance on behalf of respondents No.1 to 3 and submits that grievance of the petitioner will be looked into by respondent No.2 – Senior Superintendent of Police, Gurdaspur, District Gurdaspur and it shall take decision either way, on the representation dated 17.07.2026 (Annexure P-2) made by the petitioner.
Given the nature of order being passed, there is no necessity to seek reply by any of the respondents as no further proceedings and/or pleadings are required.
Without commenting on the merits of the case, the petition in hand is disposed of with a direction to respondent No.2 – Senior Superintendent of Police, Gurdaspur, District Gurdaspur to consider representation dated 17.07.2026 (Annexure P-2) made by the petitioner and take a ratiocinated decision thereupon, in accordance with law.
Pending application(s), if any, shall also stand disposed of.
