Heard the parties.
Learned counsel for the petitioner submits that this interlocutory application has been filed with a prayer to amend the Cr.M.P. No. 4709 of 2022 by way of incorporating the additional prayer in paragraph no.1 and prayer portion for quashing the order dated 14.03.2023 by which non-bailable warrant has been issued and order dated 05.03.2024 by which execution report of the non-bailable warrant of arrest has been sought. It is next submitted that the amendment is necessitated because of the developments which took place after filing of the criminal miscellaneous petition. It is lastly submitted that unless the proposed amendment is allowed, the petitioner will be highly prejudiced.
Learned Addl. P.P. has no serious objection.
Considering the aforesaid facts, the prayer for amendment made in this interlocutory application is allowed and the petitioner are directed to file a consolidated criminal miscellaneous petition incorporating the proposed amendment which is allowed by this order; within a week, failing which, this interlocutory application shall stand dismissed without further reference to the Bench.
This interlocutory application is disposed of accordingly.
