Judgment
The petitioner is apprehending his arrest in connection with Gumla Mahila P.S. Case No. 17 of 2016, corresponding to G.R. No. 871 of 2016
for the offence under sections 498A, 323 of the I.P.C and under section 3/4D.P. Act.
I.A. No. 9988 of 2017 has been filed on behalf of the petitioner for modification of order dated 15.09.2017 passed in A.B.A. NO. 425 of
2017.
It is stated that under order dated 15.09.2017, the petitioner was granted anticipatory bail and he was directed to surrender in the court below
on 06.11.2017 but due to diagnosed brain malaria and Jaundice, the petitioner was under treatment by Dr. S.K. Sandiliya till 11.11.2017 so the
petitioner could not surrender before the court below within time and his bail bond was not furnished, so period for surrender before the court
below may kindly be extended.
In view of the matter order dated 15.09.2017 passed in A.B.A. No. 425 of 2017 is modified to the extent that the petitioner will surrender
before the court below latest by 23.01.2018. Further, the petitioner will comply the terms and conditions as per agreement. The petitioner is
directed to deposit Rs. 6,000/for the month of October, 2017 to January, 2018 before the trial court on the date of his surrender as per Clause2
of the agreement which will be given to the O.P. No. 2. Further, the petitioner will provide a mobile set to O.P. No. 2 as per Clause 3 of the
agreement to the O.P. NO. 2 latest by 31.01.2018.
I.A. NO.9988 of 2017 stands allowed and disposed of.
The trial court is directed to submit report whether the petitioner has complied the aforesaid order or not and submit report to this court on or
before 26.02.2018.
List this case on 26.02.2018.
