Judgment
Suvir Sehgal, J
The Court has been convened through video conferencing due to Covid-19 pandemic.
The petitioner has approached this Court with tainted hands. He has given a specific declaration in Para 13 of the petition, which is supported by his affidavit and reads as under:-
"13. That no other case is pending or decided against the petitioner. Petitioner is first offender and he has not declared Proclaimed Offender by any Court of India."
State counsel, upon instructions from ASI Mahender Singh, submits that there are six cases pending against the petitioner; besides the present case, out of which, four cases have been registered under the provisions of the NDPS Act and one case has been registered under Section 379 IPC.
Faced with the facts given by the State counsel, counsel for the petitioner has sought withdrawal of the petition. Request of the counsel is declined.
The discretionary relief of anticipatory bail is not meant for a person, who suppresses facts, tries to mislead and hoodwink the court.
Petition is accordingly dismissed.
