Suvir Sehgal, J
The Court has been convened through video conferencing due to Covid-19 pandemic.
Through the instant petition, the petitioner seeks anticipatory bail in case FIR No.26 dated 07.03.2013, under Sections 406/420 of Indian Penal Code, 1860 registered at Police Station City, S.B.S.Nagar, District S.B.S.Nagar.
Prior to approaching this Court, the petitioner had filed a petition seeking anticipatory bail before the Additional Sessions Jude, SBS Nagar, which was dismissed, vide order dated 27.02.2020, Annexure P-4, inter alia, on the ground that the petitioner had concealed the fact that he had unsuccessfully filed two petitions earlier for anticipatory bail.
Anticipatory bail is a concession which is extended to an accused who approaches the Court with clean hands. An accused who misrepresents and suppresses facts is not entitled to grant of any relief from the Court. The argument of the counsel that the petitioner was not aware of the filing of the earlier two petitions is implausible.
The petition is dismissed.
