By way of this petition, the petitioner convict seek parole leave of 30 days so as to enable him to attend the post death ritual of Chalisa of his uncle viz.Abdulsalim, which is to be scheduled on 03.06.2022.

Learned APP has placed on record the verification report dated 02.06.2022 filed by the Police Sub Inspector, Godhra Railway Police Station.

The report is permitted to be taken upon on record. The factum of Chalisa ceremony of deceased uncle of the convict is scheduled on 03.06.2022 is verified and is found to be correct.

Considering the fact that the convict has been released on parole leave for a period of 10 days from 02.05.2022 to 11.05.2022, the present petition is partly allowed. The petitioner - convict is ordered to be released on parole leave for a period of 04 days i.e. from 03.06.2022 to 06.06.2022 on his furnishing personal bond of the amount of Rs.5000/- and on usual terms and conditions. The convict shall mark his presence before the nearest Police Station on every alternate day till he surrenders. The petitioner - convict shall surrender before the jail authority immediately after completion of the aforesaid period of parole leave.

Rule is made absolute to the aforesaid extent. Direct service is permitted.

The Registry is directed to communicate this order to the concerned jail authorities by way of Fax or through E-mail forthwith.
