Judgment
RP/2121, 2122, 2123 /2010 and RP/250/2011
Heard learned Counsel for the Appellant and learned Amicus Curie for the Complainants / Respondents.
It is stated by the learned Amicus Curie that the matter has been settled in so far as GeeVarghese Paickar, Susamma Panicker, G. Koshy Panicker and Tonny G. Panicker are concerned and therefore their Revision Petitions may accordingly be disposed of.
The aforesaid Revision Petitions are therefore disposed of in terms of the settlement.
RP/2254 and 2255/2010
It is submitted by the learned Counsel for the Respondent / Complainant appearing on behalf of Mr. Mohan Paul that the dispute has been settled with the Appellant and it has been agreed for receiving the entire principal amount without interest that has been paid to the Complainant / Respondent.
Learned Counsel for the Respondent who has joined online states that although the settlement has been arrived at but he has indicated that the principal amount according to him was Rs.2,40,051/- whereas the payment has been made for Rs.2,37,377/-. His submission is that a sum of Rs.2,674/- is balance towards the principal amount as well but he states that he is prepared to make a statement that the matter has been settled.
In view of the aforesaid facts since a substantial amount of Rs.2,37,377/- has already been paid, the Respondent may intimate the Revisionist about this shortage, and they shall make good the shortage if existing according to the calculations available.
The Revision Petitions therefore stand disposed of on the said terms.
RP/2400/2011
It is stated by the learned Counsel for the Revisionists that since no one is appearing for the Respondent it would be appropriate to issue directions to release the payment of Rs.57,216/- to the Respondents out of the total amount which has already been deposited before the National Commission.
The Registry shall proceed accordingly. Learned Counsel states that she will be providing the address of the Respondents in order to communicate with them to negotiate the payment.
This Revision Petition also stands disposed of with the said directions.
RP/3791/2010
Learned Counsel states that the Respondents are agreeable to accepting the principal amount but they also claim interest.
Learned Counsel for the Respondent may obtain instructions on this and assist the Bench accordingly for the disposal of the Complaint.
In view of the aforesaid status let this Revision be de-tagged and be listed separately for Final Hearing on 25.09.2024.
