CA No. 396/ND/2019 is application filed under Section 12(A) of Insolvency and Bankruptcy Code for withdrawal of the IB application No. 225/ND/2019. Learned counsel for Operational Creditor and learned counsel for IRP, make a joint statement that parties have settled the claim and letter with respect to the payment of claim and settlement is annexed as Annexure 5 signed by both the parties. The learned counsel for IRP further states that no claims have been received and hence, CoC is not formed. The learned counsel further confirms that cost and expenses incurred by the IRP are paid and nothing is due towards the same. Form-FA being the application for withdrawal is also annexed. In view of the submissions made by the learned counsels and document annexed with the application, application is allowed in terms of prayer “A” whereby allowing to withdraw the IB application No. 225/ND/2019 and disposing of the main IB application in terms of above order.
