Judgment
Mr. Vikas Rathee, Counsel is appearing on behalf of respondent no.1 and he is seeking time to file Vakalatnama and reply. Mr. Rathee submits that he shall file the reply during course of the day before this Tribunal which shall be accepted by Registry. Time to file reply is granted to the respondent no.1 till the next date of hearing.
It is submitted by the counsel for petitioner that earlier settlement was arrived at between petitioner and respondent no.1 which is annexed as at Annexure P-4 to the petition to memo of this Broadcasting Petition. This settlement is dated 2.12.2021 and as per the said settlement, respondent no.1 had agreed to make the payment of Rs.3,91,96,454/-. This amount was to be paid instantaneously and post-dated cheques were also given by the respondent no.1 which have been dishonoured.
In view of the Annexure P-4, we, hereby direct the respondent no.1 to deposit Rs.3,91,96,454/- before the Registrar of this Tribunal by way of Bank Draft in favour of “Registrar TDSAT” within a period of eight weeks from today.
If the aforesaid amount is not deposited within the aforesaid time limit, we hereby direct Mr. Gautam Kundu, Managing Director of respondent no.1 to remain personally present before this Tribunal on next date of hearing at 11.00 A.M.
This matter is adjourned to 14.11.2024.
