O R D E R

IA (IBC) 1521/2023

This application is filed by the RP, seeking leave for withdrawal of the CP whereunder in CIRP proceedings Tribunal vide order dated 19.10.2023 has admitted CD into CIRP. According to the affidavit filed by the RP, the present petition is supported 98.07% of creditors. Form-FA also has been filed along with this petition. Therefore, under the circumstances, we allow this application and order of withdrawal of the CP/153/2022 lifting of moratorium and recall of the order dated 19.10.2023 admitting the CD into CIRP. Henceforth, the CD is at liberty to function on its own. With these observations application is allowed and disposed of.

This application is filed by the RP to take on record the 2nd report certifying the committee of creditors and List of Creditors as on 17.08.2023. This application is allowed and disposed of.
