IA (IBC) 1246/2023
Ld. RP Mr. Lakkaraju Srinivas, in person present. This application is filed by the RP for leave to withdraw the above company petition on the ground that post admission of the CD into CIRP the matter has been settled between the OC and the CD and pursuant there to it was agreed by the OC to withdraw this present company petition against the CD. The RP also filed the requisite resolution of the COC which was passed with 90.41% of voting and necessary form-F also has been filed. Hence, this petition is allowed, corporate insolvency resolution process accorded against the CD on 11.04.2023 is here by withdrawn, moratorium is vacated and the CD is now liberty to function on its own through its directors according to law. Accordingly, IA (IBC)1246/2023 allowed and disposed of with no costs.
