This Application is filed for joining together in a single application. For the reasons mentioned in the MA, the same is allowed.
O.A. No. 400/2021
The 1st applicant is an Association of Health Officers in the Indian Railways. They filed this OA challenging certain orders passed in the context of granting of Conveyance Allowance. In the impugned order, it is clearly mentioned that the Conveyance Allowance is being granted to the Railway employees on par with the employees of the Central Government Health Scheme (CGHS). Though certain contentions are advanced before us, we are convinced that being a policy, it can be redressed only if any specific defect is pointed out. When the same is pointed out, learned counsel for the respondents did not raise any objection to it.
We, therefore, dispose of the OA, leaving it open to the applicants to make a representation pointing out the defects, if any, in the impugned order in this OA. As and when such a representation is made, it shall be decided on its own merit by the respondents at the earliest and not later than three months from the date of receipt of such an application. There shall be no order as to costs.
