Judgment
It has been pointed out that matter has been settled between the parties and the entire claim of the Operational Creditor in this case Rs. 13,60,073/- have been paid to the Operational Creditor and nothing remains to be paid.
Counsel appearing for the IRP also present and he also stated that till date CoC has not been constituted and therefore, he may be allowed to withdraw the petition under Section 9 of the Insolvency & Bankruptcy Code, 2016.
In this view of the situation and the fact that so far no steps has been taken to constitute the CoC, it would be just and proper if Company Petition is allowed to be withdrawn as the matter already has been settled.
Accordingly, C.P. 1087(MB)2020 is dismissed as withdrawn.
All the pending IAs/MAs filed in the Company Petition shall also be disposed of having become infructuous.
