The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking direction to respondent No.3 to release arrear of dearness allowance along with interest as per order dated 20.12.2022 from 01.07.2021 to 31.03.2023 and arrears of 7th Pay Commission as granted to other employees. They are further seeking direction to respondents to decide their legal notice dated 20.12.2025.

The petitioners during 2005-2019 joined respondent on the post of Junior Basic Training/Trained Graduate Teacher under Samagra Shiksha Abhiyan, Chandigarh. They are posted in different schools of the Chandigarh Administration. The respondent revised Dearness Allowance w.e.f. 01.07.2021, 01.01.2022 and 01.07.2022. The respondent released arrears of dearness allowance to few employees. The petitioners visited office of respondent and requested to release their arrears. This Court vide order dated 18.02.2025 passed in CWP No.1683 of 2025 has directed the respondent to release arrears along with interest @ 6% p.a.

Learned counsel for the respondents submit that U.T. Administration has complied with order dated 18.02.2025 (Annexure P-3) passed by this Court in CWP No.1683 of 2025, Sushila and others v. Union Territory of Chandigarh and others, however, is likely to file an Intra Court Appeal against order dated 10.11.2025 passed by this Court in CWP No.30896 of 2025, Deepak Sharma and others v. Union Territory of Chandigarh and others.

Heard the arguments and perused the record.

It is undisputed that claim raised in the instant petition is squarely covered by order passed by this Court in Deepak Sharma and others (supra). The matter cannot be kept pending merely on the ground that respondent is contemplating to file Intra Court Appeal against the order which is squarely applicable to the instant petition.

In the backdrop, the petition stands disposed of in terms of order dated 10.11.2025 passed by this Court in Deepak Sharma and others (supra).
