This original application under Sections 14 and 15 of National Green Tribunal Act, 2010 (hereinafter referred to as ‘NGT Act, 2010’) has been registered on an application moved by Independent School Association representing interest of plying of school buses with prayer that respondents i.e. Union of India, Ministry of Road, Transport and Highways, State of Uttar Pradesh through Transport Commissioner, Regional Transport Authority, Saharanpur and Assistant Regional Transport Officer, Muzaffarnagar be directed to implement statutory provisions contained in the Motor Vehicles Rules, 2022 amended by Central Government as well as State Government from time to time.

When we questioned as to how this matter is within the jurisdiction of this Tribunal and how jurisdiction under Sections 14 and 15 of NGT Act, 2010 is attracted, learned Counsel appearing for applicant, after some arguments, stated that she may be permitted to withdraw this original application so that she may avail remedy elsewhere as available in law. Request is accepted. Original Application is dismissed as withdrawn with liberty as prayed for.
